These Terms and Conditions ("Terms") govern your use of our website & customer service outsourcing packages.
By subscribing to the Gold Plan or the Bronze Plan, you agree to comply with and be bound by these Terms. Please read them carefully before using our services.
Conditions of Use of the Website
Access to the Website
Forecrest will make its best effort to ensure the website is accessible 24/7, although we are not under any legal obligation to do so. Access to the website may be interrupted in case of planned maintenance, force majeure, or any event outside of Forecrest’s control. Forecrest shall not be held responsible in case of any interruption nor for the consequences of any interruption that may result to visitors.

Services are offered for a flat-monthly fee.
Bronze Plan
The Bronze Plan offers high-quality agents to integrate into your existing operations.
This plan provides scalable solutions to meet evolving business demands.
Services are designed to complement and enhance your current customer service operations.
Subscription and Payment
Subscription
By subscribing to either the Gold Plan or the Bronze Plan, you agree to pay the associated fees.
Subscriptions are billed monthly unless otherwise agreed upon in writing.
Payment Terms
Payments are due on the first day of each billing cycle.
Late payments may result in service suspension until the account is brought current.
All fees are non-refundable unless otherwise specified.
Service Level Agreement (SLA)
Performance
Forecrest commits to providing high-quality customer service as outlined in the respective plan.
Specific performance metrics and targets will be mutually agreed upon during the onboarding process.
Uptime
• Forecrest aims to ensure the highest possible uptime for its services, targeting a 98.9% uptime rate.
Support
Gold Plan clients’ customers will receive 24/7 support.
Bronze Plan clients’ customers will receive support during standard business hours otherwise agreed upon.
Responsibilities
Forecrest Responsibilities
Provide trained and dedicated customer service agents as per the subscribed plan.
Maintain the quality and consistency of customer service operations.
Ensure data security and confidentiality.
Client Responsibilities
Provide Forecrest with necessary access to systems and information required for customer service operations.
Ensure timely payment of fees.
Provide feedback and cooperate with Forecrest to ensure service quality.
Confidentiality
Data Protection
Forecrest will implement industry-standard measures to protect the confidentiality and integrity of your data.
Both parties agree to comply with applicable data protection laws and regulations.
Confidential Information
• Both parties agree to keep all confidential information private and not to disclose it to third parties without prior written consent.
Termination
Termination by Client
Clients may terminate their subscription with 30 days written notice.
Any fees paid in advance for the period after termination will be refunded on a pro-rata basis.
Termination by Forecrest
Forecrest may terminate the subscription if the client breaches these Terms and fails to rectify the breach within 14 days of receiving notice.
Forecrest reserves the right to terminate services immediately if the client engages in illegal or unethical activities.
Liability
Limitation of Liability
Forecrest’s liability is limited to the amount paid by the client for the specific month in which the incident occurred.
Forecrest is not liable for any indirect, incidental, or consequential damages.
Indemnification
• Clients agree to indemnify and hold Forecrest harmless from any claims, damages, or losses resulting from the client’s use of the services.
Miscellaneous Amendments
• Forecrest reserves the right to amend these Terms. Clients will be notified of any changes at least 30 days in advance.
Governing Law
• These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Forecrest operates.
Dispute Resolution
• Any disputes arising out of these Terms shall be resolved through amicable negotiation. If unresolved, disputes shall be submitted to binding arbitration.
Entire Agreement
• These Terms constitute the entire agreement between the Client and Forecrest and supersede all prior agreements and understandings.
By subscribing to Forecrest’s Gold Plan or Bronze Plan, you acknowledge that you have read, understood, and agree to these Terms & Conditions.
